This disclaimer should be read together with our Privacy Policy.
This disclaimer does not govern the use of our clinical software product, Lumen, available at lumen.trenthos.com. Use of Lumen is governed by separate clinical service agreements between Trenthos and the licensed practice or clinic, together with any in-product terms made available to authorised users.
General information only
The Site is a corporate and marketing website. It describes Trenthos, our approach to building clinical software, and our software products.
Information on the Site is provided for general informational purposes only. While we make reasonable efforts to ensure that information on the Site is accurate and current at the time of publication, we do not warrant the accuracy, completeness or timeliness of any information on the Site. Information may change without notice, and we may update, modify, or remove content at any time, with or without prior notice.
You should not rely on information on the Site as the basis for any clinical, business, financial, legal, regulatory, procurement, or operational decision. Where firm commitments or current information are required, please contact us directly to discuss your specific situation.
No medical, clinical or professional advice
Trenthos builds software for use by medical professionals. Nothing on the Site is intended to be, and nothing should be relied upon as, medical advice, clinical advice, or a substitute for the professional judgement of a qualified healthcare provider.
The Site does not:
- provide diagnosis, prognosis or treatment recommendations;
- provide clinical decision support of any kind;
- offer a clinical consultation or doctor-patient relationship;
- recommend, evaluate or prescribe any medicine, device, intervention or course of management.
If you are a patient: please consult a qualified healthcare professional. Do not delay seeking medical advice or disregard medical advice on the basis of anything you read on the Site. In a medical emergency, telephone Triple Zero (000) within Australia, or the equivalent emergency service in your jurisdiction.
If you are a clinician: do not use the Site content as the basis for clinical decisions. References on the Site to clinical workflows, calculators, or coding systems (including descriptions of features within Lumen) are provided to describe the product. They are not a substitute for your own clinical judgement, your specialty college's guidance, current evidence, or the current text of the relevant standard, schedule or schema.
The Site also does not provide legal, regulatory, financial, taxation or other professional advice. You should seek advice from a qualified professional before acting on any information on the Site.
Forward-looking statements about Lumen and our roadmap
The Site contains statements about features, integrations, certifications, and capabilities of Lumen and other Trenthos software that are under development, in private pilot, or subject to external approval. These statements include, without limitation, references to:
- Medicare claiming via ECLIPSE and the Tyro Health Easy Claim bridge;
- conformance with the Australian Digital Health Agency's My Health Record specification;
- integration with Medical Objects, HealthLink, or other secure messaging providers (HL7 v2 and FHIR);
- access to the Healthcare Identifiers Service (IHI, HPI-I, HPI-O);
- NASH PKI certificate provisioning;
- independent security testing, penetration testing, or OWASP assessment of the Service before general availability;
- Medicare Benefits Schedule, DVA and bulk-billing support;
- imaging via DICOM, biometry import and IOL calculator support;
- migration paths from existing practice management systems (including Best Practice VIP.net); and
- other clinical or administrative modules described on the Site.
Such statements describe our current intent and direction. They are not promises that any particular feature, integration, conformance, certification, or product will be delivered, completed, certified, supported, or made available on any particular timeline, or at all. Scope, capability, behaviour, pricing, supported devices, supported jurisdictions, and availability of Lumen may change as the product matures.
Government and third-party approvals (including those granted or denied by Services Australia, the Department of Health and Aged Care, the Australian Digital Health Agency, the Healthcare Identifiers Service, and accredited secure-messaging vendors) are outside the sole control of Trenthos, and we do not warrant that any such approval will be granted, retained, or granted within any particular timeframe.
Do not rely on forward-looking statements on the Site when making procurement, clinical workflow, regulatory or financial decisions. Where firm commitments are required, please contact us to discuss a written agreement specific to your practice.
No warranty
To the maximum extent permitted by law, and subject to Section 9 (Limitation of Liability) below:
- the Site and all content on the Site are provided "as is" and "as available", without representation or warranty of any kind, express or implied;
- we do not warrant that the Site will be uninterrupted, secure, error-free, free of viruses or other harmful components, or that defects will be corrected;
- we do not warrant that information on the Site is accurate, complete, current, reliable, suitable for any particular purpose, or fit for use in clinical or operational settings;
- we do not warrant that any feature, capability, integration or conformance described on the Site will be available, supported, certified, or compatible with any particular system, workflow, device, browser, jurisdiction, or use case at any time.
Where any representation, warranty, guarantee, term or condition would otherwise be implied into the use of the Site by statute, common law or otherwise, it is excluded to the maximum extent permitted by law, subject always to Section 9.
Third-party links and integrations
The Site may link to, refer to, or describe websites, products, services, vendors, or integrations operated by third parties - for example, Amazon Web Services, Google, Services Australia, the Australian Digital Health Agency, Medical Objects, HealthLink, Tyro Health, NCTS, Zeiss, Topcon, Heidelberg, and other vendors or government bodies.
References to third parties on the Site are provided for convenience and information only. We do not endorse, sponsor, control, or take responsibility for the content, accuracy, availability, security, performance, or privacy practices of any third party. Inclusion of a third-party reference on the Site does not imply that the third party endorses Trenthos.
Your use of any third-party website, product or service is governed by that third party's own terms and policies, which you should review before using the service. We are not responsible for any loss or damage arising from your use of, or reliance on, any third-party website, product or service.
Intellectual property
All content on the Site - including text, layout, design, graphics, source code, photographs, logos, brand marks, the names "Trenthos" and "Lumen", and any other Trenthos product names - is owned by Trenthos or used under licence, and is protected by Australian and international copyright, trademark and other intellectual property laws.
You may view content on the Site and make a reasonable number of copies for your personal, non-commercial reference, provided you do not modify the content and you retain all proprietary notices. Any other use - including reproduction, redistribution, framing, embedding, scraping, text and data mining, training of machine-learning models, or any commercial use - is not permitted without our prior written consent.
Names, logos and trademarks of third parties referenced on the Site remain the property of their respective owners. Reference to such marks on the Site does not constitute or imply any licence or endorsement.
Acceptable use
You agree not to use the Site to:
- engage in conduct that is unlawful, threatening, defamatory, obscene, infringing or otherwise harmful;
- interfere with or compromise the operation, security or integrity of the Site - including by attempting denial-of-service attacks, brute-force enumeration, exploit testing, or by bypassing access controls;
- conduct automated access or scraping at a scale beyond ordinary human use;
- impersonate Trenthos or any other person or entity;
- collect, store or process personal information about other users; or
- introduce viruses, worms, malware, or other harmful code.
We may suspend, restrict, or block access to the Site at our discretion, including to protect the integrity of the Site, our infrastructure, or our users. Suspected unlawful conduct may be reported to law enforcement.
Limitation of liability
9.1 Australian Consumer Law
Nothing in this disclaimer excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), or any other law that cannot be excluded by agreement.
9.2 Limits and exclusions
Subject to Section 9.1 above, and to the maximum extent permitted by law:
- our total aggregate liability to you arising out of or in connection with your use of, or inability to use, the Site is limited to AUD $100;
- we are not liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including any loss of profits, revenue, savings, business, opportunity, goodwill, reputation, data or use of data, however caused, and whether based in contract, tort (including negligence), statute or otherwise; and
- we are not liable for any clinical, medical, regulatory, financial, taxation or operational decision made on the basis of any information on the Site (see Section 3 above).
9.3 Re-supply remedy
If we are liable to you for a failure to comply with a non-excludable consumer guarantee in connection with services provided through the Site, our liability is limited (at our option) to re-supplying the services or paying the cost of having the services re-supplied, to the extent permitted by law.
9.4 Your indemnity
To the extent permitted by law, you agree to indemnify Trenthos and its directors, officers, employees, agents and licensors against all loss, damage, claims, demands, costs and expenses (including reasonable legal costs) that arise from your breach of this disclaimer or your misuse of the Site, except to the extent caused by Trenthos's negligent acts or omissions.
External references
Where the Site references external documents - statutes, regulations, government schedules, standards, conformance specifications, or guidelines - those references are provided for orientation only. The authoritative version of any such document is the version maintained by the relevant publisher (for example, the Federal Register of Legislation, Services Australia, the Australian Digital Health Agency, Standards Australia, or HL7 International).
We do not undertake to maintain references on the Site in line with subsequent versions of those documents, and references on the Site should not be treated as a current or authoritative statement of the relevant law, standard or schema.
Changes to this disclaimer
We may update this disclaimer from time to time. Changes take effect when they are posted to the Site. The current version and effective date are shown at the top of this page. Your continued use of the Site after the effective date of a change constitutes acceptance of the updated disclaimer.

Governing law and jurisdiction
This disclaimer is governed by the laws of the State of Queensland, Australia. You and Trenthos submit to the exclusive jurisdiction of the courts of Queensland, and the courts of appeal from them, for any dispute arising out of or in connection with this disclaimer or your use of the Site.
If any provision of this disclaimer is held to be invalid, illegal or unenforceable, the remaining provisions will continue in full force and effect, and the invalid, illegal or unenforceable provision will be modified to the minimum extent necessary to make it valid, legal and enforceable.
